It broadens the existing segmentation approaches, which are based more on the employers view of firm-flexibility during demand-fluctuation. Therefore the thesis paper combines the segmentation theory with an extended insideroutsider approach. The assumption is, that for the price of higher internal flexibility, the work council stabilises the employment of the insiders ( Stammbeschäftigte ), which are often well organised, while atypical workers ( Randbeschäftigte ) in an Entrant or Outsider position provide the external flexibility in a stronger extent than in enterprises without a work council. Further it will be assumed that the interrelations intensify with the size of enterprises and the work councils tradition and activity. The assumptions are tested in descriptive analyses and regression models for different enterprise sizes with data from the IAB-Betriebspanel 2004 and the WSIBetriebsrätebefragung 2004/2005. The results confirm the assumptions above partially. Work councils reduce the personal fluctuation of insiders (External flexibility) and enhance the probability of labour time accounts (Internal flexibility) in nearly all models. Otherwise, independent from the economic situation, in this analysis work councils seem to reduce atypical employment instead of enhancing it.
