The Act represents an attempt on the part of the German legislature to cope with mass litigation before German courts and was promulgated to provide a procedural device in contrast to American-style class actions. The article sets out the basic system of model case litigation under the new Act and compares it with group actions as provided for in other member states of the European Union.
