Abstract
The license and contract law on the provision of persons under the statutory insurance scheme with therapeutical services and auxiliary devices falls under the law of other service performers . It covers the integration into the supply network and the terms of the execution of the service. The regulations in nursing insurance law (German Social Security Code Sozialgesetzbuch - SGB XI) follow on from the provisions in health insurance law (SGB V), but differ from these in essential aspects. Generally, there is a link between the service performer law and the law on benefits, i. e. the legal entitlement of the party insured to receive therapeutical services and auxiliary devices.

The thesis deals with the legal questions arising in this subject field from the decisions or the behaviour of health and nursing insurance institutions as well as from the role of the person insured in the demand for such services/products. In this context, problems with regard to European and competition law as well as functional issues are also considered.

Das Zulassungs- und Vertragsrecht zur Versorgung gesetzlich Versicherter mit Heil- und Hilfsmittel gehört zum Recht der "sonstigen Leistungserbringer". Es umfasst die Einbindung in das Versorgungssystem und die Modalitäten der Leistungsausführung. Die Regelungen im Pflegeversicherungsrecht (Sozialgesetzbuch - SGB XI) knüpfen an die Vorschriften im Krankenversicherungsrecht (SGB V) an, unterscheiden sich aber in wesentlichen Punkten von diesen. Allgemein besteht eine Verknüpfung des Leistungserbringerrechts und des Leistungsrechts, also dem gesetzlichen Anspruch des Versicherten auf die Versorgung mit Heil- und Hilfsmitteln.

Die Arbeit widmet sich den rechtlichen Fragen, die sich in diesem Themenfeld im Einzelnen durch Entscheidungen bzw. Verhalten von Kranken- und Pflegekassen sowie der Rolle des Versicherten bei der Nachfrage dieser Dienstleistungen/Produkte ergeben. Dabei wird auch auf europarechtliche, wettbewerbsrechtliche und prozessuale Problemstellungen eingegangen.
