Il Bundesverfassungsgericht e Corte di giustizia dell’Unione europea si fronteggiano sul mandato d’arresto europeo, l’uno sfoderando l’arma dell’Identitätskontrolle e l’altra negando che essa possa essere utilizzata. Al di là del casus belli, il nocciolo della contesa è la garanzia dei diritti fondamentali nel sistema multilivello, che la formula della tutela prevalente contenuta nell’art. 53 della Carta dei diritti fondamentali dell’Unione europea non è riuscita a risolvere. La questione porta con sé quella dell’organo deputato ad assicurarne in ultima istanza la protezione.
Zusammenfassung in einer weiteren Sprache
The Bundesverfassungsgericht and the Court of Justice of the European Union are confronting each other on the European arrest warrant, the first drawing forth the weapon of the Identitätskontrolle and the latter denying that it can be used. Beyond the casus belli, the core of the dispute regards the guarantee of fundamental rights in the multilevel system, that the formula of prevailing protection stated by the Art. 53 of the Charter of Fundamental Rights of the European Union is not able to solve. The issue carries with itself that of the court called upon as a last resort to safeguard those rights.
