The abuse of telephone cards (used in Germany to telephone at public call-boxes) happens with manipulated telephone cards, which are copied or imitated to telephone without paying fee for telephone service. Such manipulated cards are called telephone cards simulators and are distributed and used.
All action with those telephone cards simulators (production, usage, buying, selling, leasing, renting, etc) are analysed against German criminal law by building examples respectively cases. Concerned are § 152a, § 267, § 268, § 269, § 303a, § 202a, § 263, § 265a and § 259 of the StGB (German criminal law).
Result of these broad exploration is when and where liability to punishment is concerned or is not concerned. Two gaps in law are found, which makes legislators initiative necessary.
Zusammenfassung in einer weiteren Sprache
Mißbrauch von Telefonkarten stellt sich so dar, daß Telefonkarten dergestalt manipuliert oder nachgebaut werden, daß man mit ihnen an öffentlichen Fernsprechern kostenlos telefonieren kann. Diese sogenannten Telefonkartensimulatoren werden verbreitet und benutzt.
Die Handlungen mit Telefonkartensimulatoren (Herstellen, Benutzen, Kaufen, Verkaufen, Ankaufen, Mieten, Vermieten, etc.) werden anhand von Fallbeispielen strafrechtlich untersucht. § 152a, § 267, § 268, § 269, § 303a, § 202a, § 263, § 265a und § 259 StGB werden für die rechtliche Prüfung herangezogen.
Das Ergebnis dieser umfassenden Untersuchung ist die Darlegung, wann welche Strafbarkeit vorliegt und die Feststellung von zwei Strafbarkeitslücken, durch die eine Initiative des Gesetzgebers erfordlich werden.
