The tools of public choice theory are applied to some questions that arise in the constitutional process of European integration. First it is asked what preconditions must be fulfilled before a union of formerly independent states can develop at all. Here the importance of certain degree of similarity of preferences is stressed. Second the contents of such a constitutional contract are examined, namely what decison-making rules shall be used on the operational level by the members of the union. It is shown that the choice of a particular voting rule — in the EC the unanimity rule is applied in most cases — has considerable impact on the cost side of the integration process (via decision-making costs) as well as on the relative power of the members vis-à-vis each other in the decisionmaking body, the Council of Ministers. In the final section we offer some alternative explanations for the empirical fact that despite the application of unanimity rule a great extent of redistribution takes place between member states through Community activities.
